TERMS AND CONDITIONS OF USE
When we use the words:
“Bridges Curriculum” we mean our e-learning resource available on the Service Site designed to assist children with an autism spectrum disorder including Asperger syndrome to develop social understanding and social skills;
“Parent Network” we mean that part of the Site listing certain details about registered users and their children (where such registered users have agreed to this);
“Sites” mean the Public Site and the Service Site;
“we”, “us” and “our” we mean Bridges in Social Understanding Limited; “you” or “your” we mean the registered user of the Service Site, who must be over the age of 18 and the parent or guardian of a child with an autism spectrum disorder including Asperger syndrome;
“your child” we mean the child who will be accessing the Service Site using your account under your supervision for the Bridges Curriculum (or, where we have issued a password to such child to directly access the Service Site, who will directly access the Service Site using such password)
2.1 You must be 18 years of age or over to register to use any of the services on our Service Site. By registering to use any of the services on our Service Site, you represent and warrant that you are at least 18 years of age and agree to be bound by these terms.
2.2 When you register for the Bridges Curriculum, you will be asked to choose a user name and a password and to provide information about your child, including your child’s name; age; gender, the type of educational placement attended; hobbies and interests. These search parameters are used in the Parent Network to help parents find children of the same age/gender/educational placement/interests as their child.
2.3 Your password enables you to access a dashboard listing an account for each child whose information you have provided. Access to the Bridges Curriculum will be via such dashboard.
2.4 You may register in respect of more than one child. You must have a separate account for each child who will be using the Bridges Curriculum. You must only use an account for the child named in that account, and must ensure that no child except the child named in that account uses that account.
3. Your user name and password
3.1 Your and your child’s user names for use of the Bridges Curriculum must be your/your child’s actual name. If we consider any user name which is not your actual name to be inappropriate we will refuse your request to join the Site and you will be required to restart the registration process and to choose a different user name.
3.2 You must keep your Service Site password confidential and must not disclose your password to any third party, including to your child. If we provide your child with his/her own password you must ensure that your child keeps that password confidential and does not disclose that password to any third party. Except where we have provided your child with his/her own password, if your child wishes to use the Service Site, you must log your child in yourself using your password.
3.3 You must tell us as soon as possible if you or your child reasonably suspects or becomes aware that a third party has used your or your child’s password to access the Service Site. At the same time, you must change your password (or ensure that your child changes his/her password) to prevent any further unauthorised access to the Service Site.
3.4 We will have no liability for any misuse of your or your child’s password. You are responsible for all use of our Site with your or your child’s password whether or not such use was yours or your child’s.
4. Using the Bridges Curriculum
4.1 Information on the Public Site regarding the different levels of the Bridges Curriculum (Foundation, Intermediate or Advanced) (“Levels”) is intended for general guidance only, as some children and young people may benefit from the Level below or even above their chronological age, and we make no representation as to which Level is most suitable for your child.
4.2 Each Level of the Bridges Curriculum comprises a number of modules (“Modules”) and each Module comprises a number of lessons. As the Modules within each Level of the Bridges Curriculum and the lessons within each Module must be completed in order, you cannot access any Module before completing all the preceding Modules, and you cannot access any lesson before completing all the preceding lessons in that Module. You also cannot access a new Module until your child has completed a progress measure in respect of the previous module.
4.3 As you have requested immediate access to the Bridges Curriculum, we will give you access to the first lesson of any Module you purchase immediately following your payment in full to us in respect of that Module. You cannot access subsequent lessons until seven (7) days after the date on which you accessed the previous lesson. This is to maximise the benefit that your child derives from the Bridges Curriculum by affording sufficient time for him/her to reflect upon the lessons and skills taught.
4.4 Each time you complete a Module, you will be alerted to complete the revision lesson from two Modules ago. Once the revision lesson has been completed, the alert will disappear. You will also receive a similar alert for Progress Measures.
4.5 Some of the poster materials may be downloaded and printed by you as reference materials. You must use such materials solely for private personal use in connection with your child registered for the Bridges Curriculum, and you must not use such materials for any other purpose or give access to such materials to any person other than your child registered for the Bridges Curriculum.
4.6 You must purchase at least one entire Module of the Bridges Curriculum at a time and pay the full value of that Module by one advance payment.
4.7 You do not need to purchase any subsequent Modules of the Bridges Curriculum and may terminate your contract with us for the Bridges Curriculum at any time by giving us notice by the method set out in paragraph 6.2. Except where you exercise your right to cancel under paragraph 6, no refund will be made in respect of any unused credits paid for by you.
4.8 You have no obligation to complete any Module purchased by you, but no refund will be made in respect of uncompleted lessons.
5. Use of Parent Network
This paragraph 5 applies if you opt to purchase the Bridges Curriculum and opt (by ticking the box on the Service Site) to allow us to add your details to the Parent Network section of the Service Site.
5.1 You must not allow your child to access Parent Network.
5.2 You acknowledge that we will make available on the Parent Network section of the Service Site your name and country of residence (as provided to us by you) and that such data can be accessed by any other registered user who has opted to join Parent Network.
5.3 You acknowledge that the information you provide to us regarding your child’s age, educational placement and hobbies and interests will be stored in a database and that any registered users who have opted to join Parent Network may search using the parameters of age, location, educational placement and/or interests to identify other registered users whose children fall within the searched parameters. For the avoidance of doubt, no other registered user will have direct access to the information which you provide to us regarding your child.
5.4 The purpose of Parent Network is to enable registered users to communicate with each other, if they wish, to share experiences and useful information in dealing with a child with an autism spectrum disorder including Asperger syndrome. You must only use data relating to other registered users available on Parent Network for this purpose. You must not misuse, abuse or share any such data or use or reproduce any such data for any commercial purpose.
5.5 We will use reasonable endeavours to provide a message link between registered users on Parent Network who wish to communicate with each other. Any use by you of the message link feature must comply with the acceptable use terms set out in paragraph 10.
5.6 The listing of your data on Parent Network and any contact or communication between you and any person whose data are listed on Parent Network (whether using our message link feature or otherwise) is entirely at your own risk, and we accept no liability whatsoever.
5.7 As data relating to registered users available on the Parent Network is provided by those registered users, you acknowledge that we cannot verify whether such data is correct and accordingly we do not accept any liability if any such data is incorrect.
5.8 You may opt to cease being a member Parent Network at any time by giving us notice by the method set out in paragraph 6.2, and we will also automatically terminate your membership of Parent Network on termination of your contract for the Bridges Curriculum. On termination of your membership, we will remove your data from Parent Network and you will no longer be able to access Parent Network.
6. Rights of cancellation
6.1 The Consumer Contracts (Information, Cancellation and Additional Payments) Regulations 2013 gives you the right to cancel your contract with us for the Bridges Curriculum within fourteen (14) days from the day on which that contract is concluded (“Cancellation Period”) without giving any reason. However, as you have requested that we commence provision of the Bridges Curriculum immediately, this right is subject to the exceptions set out in paragraph 6.3.
6.2 You must notify us of your decision to cancel your contract with us by a clear statement made by email.
6.3 As you have requested that we commence provision of the Bridges Curriculum immediately:
(a) your right above to cancel your contract with us for the Bridges Curriculum will be lost if we complete the provision of the Bridges Curriculum before the end of the relevant Cancellation Period;
(b) unless paragraph 6.3(a) applies, you can still exercise your right above to cancel the contract but, if you do so, you must still pay us for any part of the Bridges Curriculum which we have provided up to the time that we are informed of your decision to cancel. The amount payable by you to us in respect of your cancelled contract with us for the Bridges Curriculum will be the cost of any lessons made available to you.. We will notify you of the amount payable by you and will deduct this amount from the reimbursement we make to you.
6.4 If you exercise your right above to cancel your contract for the Bridges Curriculum with us, we will reimburse to you the amount we received from you for the Bridges Curriculum less any amount payable by you to us under paragraph 6.3(b). We will make such reimbursement without undue delay and not later than the end of fourteen (14) days after the day on which we are informed of your decision to cancel. You will not incur any fees as a result of the reimbursement
7. Our rights to suspend or terminate
7.1 If you or your child is in breach of any of these terms or any laws which apply to your use of the Sites, we may:
(a) restrict access to you and/or your child to all or any part of the Service Site and/or suspend provision of the Bridges Curriculum and/or Parent Network to you or your child (as applicable); or
(b) terminate your contract with us for the Bridges Curriculum by giving you notice by email.
7.2 In any such event, no refund will be made in respect of the fee paid by you for the suspended or terminated service or in respect of any unused credits paid for by you.
8. Acceptable use of the Sites
8.1 You must not and must ensure that your child does not:
(a) use the Sites or their features in such a way that it interrupts, damages or renders the Site or its features less effective;
(b) use the user name or password of another user or attempt to impersonate another user;
(c) misuse the Sites by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful; or attempt to gain unauthorised access to the Sites, the server on which the Sites are stored or any server, computer or database connected to the Sites; or attack our Sites via a denial-of-service attack.. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Sites will cease immediately;
(d) post to our Sites or transmit through the message link feature on Parent Network any message or materials which:
(i) are capable of being threatening, obscene, harmful, defamatory, pornographic or otherwise unlawful; and/or
(ii) violate or infringe in any way the rights of others (including intellectual property rights, rights of confidentiality, or rights of privacy); and/or
(iii) cause distress or inconvenience; and/or
(iv) express opinions that others may find vulgar, crude, sexist, racist or otherwise offensive; and/or
(v) are otherwise illegal.
(e) use the Sites or their features to advertise or promote your own products and services or those of a third party;
(f) access or attempt to access accounts belonging to other registered users of the Sites;
(g) interfere with or attempt to interfere with any security measures relating to the Sites.
8.2 Any message or content you post to or transmit through our Sites will be considered non-confidential and non-proprietary.
8.3 We have the right to disclose your identity to any third party who claims that any message or content which you post to or transmit through our Site constitutes a violation of their intellectual property rights, or of their right to privacy.
8.4 We will not be responsible or liable for the content or accuracy of any message or content which you or any other registered user of our Site post to or transmit through our Sites.
8.5 We have the right to remove any message or content you post to or transmit through our Sites if, in our opinion, it does not comply with the standards set out in this paragraph 8.
8.6 You agree that all information you provide to us is true, accurate and up-to-date and that you will promptly notify us of any change to any personal information regarding you or your child which you have provided to us.
9. Intellectual property
9.1 We are the owner or licensee of all intellectual property rights in our Sites and in the material made available on it. These rights are protected by both national and international copyright laws. All such rights are reserved.
9.2 You must not use any information on or material published on our Sites for commercial purposes without first obtaining a licence to do so from us.
10. Access to the Site
10.1 We do not guarantee that our Sites or any content on our Sites will always be available or free from interruption. We will not be liable to you if for any reason our Sites or either of them are unavailable at any time.
10.2 You are responsible for making all necessary arrangements in order for you and/or your child to access the Sites and use any of the features on it.
10.3 We do not accept any responsibility or liability for any lack of functionality of the Sites or failure to provide its features or services if this is due to your equipment, for example, your Internet connection or device or software settings.
11. Warranties and liability
11.1 We warrant that the Bridges Curriculum will be provided with reasonable skill and care.
11.2 Save as set out in paragraph 11.1, to the extent permitted by the laws of England and Wales we exclude all conditions, warranties, representations or other terms which may apply to our Site or any content on it or the Bridges Curriculum whether express or implied.
11.4 Save as set out in paragraph 11.3, we exclude all liability to the fullest extent permitted by the laws of England and Wales.
11.5 Without limiting paragraph 11.4, we will not be liable to you and/or your child:
(a) for any loss or damage, whether in contract, tort, breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with your or your child’s use of, or inability to use, our Sites or either of them or for your or your child’s use of or reliance on any content displayed on or provided through our Sites;
(b) for any loss of profit, loss of business, business interruption, or loss of business opportunity, arising under or in connection with your or your child’s use of, or inability to use, our Sites or either of them;
(c) for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your or your child’s computer equipment, computer programs, data or other proprietary material due to your or your child’s use of our Sites or to your or your child’s downloading of any content on or any website linked to our Sites.
12. Use of hyperlinks
Where our Sites contain links to other sites provided by third parties, these links are provided for your information only. We have no control over the content of the contents of any site provided by a third party.
